Terms & Conditions

1. Purpose

These Terms and Conditions of Sale (T&Cs) govern the sale of products offered on www.nectusbio.com (the “Website”) by the ARGANIUM Cooperative, brand NECTUS (the “Seller”). The Website is intended for consumers. Any order placed implies the full and unconditional acceptance of these T&Cs.

2. Produits

NECTUS markets in particular:

Cosmetics based on oils (argan, prickly pear seed, etc.);
Food products (culinary argan oil, amlou, etc.).

The characteristics, ingredients, and usage precautions are indicated on each product page. Product images are non-contractual but representative. Products are offered subject to availability.

3. Prices

Prices are displayed in Moroccan dirhams (MAD), all taxes included (TTC), and excluding shipping fees.
The applicable price is the one shown at the time of the order. Promotions and discount codes cannot be combined (unless otherwise specified).

4. Orders

The Customer selects items, validates the cart, enters contact details, and chooses delivery and payment options.
The contract is concluded when NECTUS sends the confirmation email. NECTUS may cancel an order in case of obvious error, non-payment, fraud, or other legitimate reason.

5. Payment

Accepted methods:

Bank card (CIB/Visa/Mastercard) via a secure provider;
Cash on Delivery (COD) in Morocco.

Orders are shipped only after payment authorization (except COD). If payment is refused by the provider, the order is cancelled.

6. Invoice

The invoice is sent by email (and/or available in the customer account) and includes details of the products, taxes, and fees.

7. Delivery

7.1. Areas & Methods — Delivery within Morocco via partner carriers. International delivery: available.
7.2. Indicative Timeframes — Order preparation within 24–48 business hours, followed by delivery within 24–72 hours (excluding weekends/holidays). Timeframes are not guaranteed in cases of force majeure or peak activity.
7.3. Fees & Free Shipping — Express delivery is free from 599 MAD (Morocco). Below this threshold, fees are displayed in the cart/checkout.
7.4. Receipt & Reservations — Risks are transferred upon delivery of the package. The Customer must check the condition of the goods and submit specific reservations within 48 hours to both the carrier and NECTUS in case of damage or missing items.

8. Right of Withdrawal & Returns

8.1. Period — NECTUS grants 14 days from the date of receipt to withdraw without justification.
8.2. Exceptions (Hygiene & Food Products) — For hygiene/health reasons, unsealed or used cosmetics cannot be returned. Food products (oil/amlou) cannot be returned if the packaging has been opened/altered.
8.3. Procedure (RMA) — Notify your return request at contact@nectusbio.com . After RMA authorization, the return address will be provided by email. Products must be returned new, unopened, complete, and in their original packaging.
8.4. Refund — Refunds are processed within 14 business days after the return is validated.
8.5. Initial Shipping Fees — Non-refundable, except if the return is due to a NECTUS error or a confirmed defect (same rules as the Return Policy).

9. Non-conformity / Defective Product

In the event of a damaged, expired, leaking, or non-conforming product, please contact contact@nectusbio.com with photos within 48 hours of receipt. NECTUS will, at your choice, provide a replacement, a store credit, or a refund. In such cases, return and reshipping costs are covered by NECTUS.

10. Legal Warranties

Products benefit from the applicable legal warranties (conformity / hidden defects). Any misuse or improper storage excludes warranty coverage.

11. Liability

NECTUS is not liable for indirect damages. The information provided does not replace the advice of a healthcare professional. NECTUS is not responsible for carrier delays or force majeure events.

12. Intellectual Property

The Website and its elements (texts, visuals, trademarks, logos, photos) are protected. Any unauthorized reproduction/use is prohibited.

13. Personal Data

Data is processed in accordance with the Website’s Privacy Policy.
Rights of access, rectification, erasure, and objection may be exercised at: contact@nectusbio.com .

14. Claims – Amicable Settlement

Claims may be submitted to: contact@nectusbio.com .
In case of dispute, the Customer should first seek an amicable solution (mediation/conciliation) before taking any legal action.

15. Force majeure

In the event of circumstances making performance impossible (strike, disaster, network failure, carrier disruption, etc.), NECTUS’s obligations are suspended for the duration of the event.

16. Governing Law – Jurisdiction

These Terms and Conditions of Sale are governed by Moroccan law. Any dispute shall fall under the competent courts of the Seller’s registered office, after an attempt at amicable settlement.

17. Amendments to the T&Cs

NECTUS may amend these T&Cs at any time. The applicable T&Cs are those in force on the date of the order.
