Purpose<\/h2>\n\n\n\n<p class=\"translation-block\">These Terms and Conditions of Sale (T&amp;Cs) govern the sale of products offered on <strong><a href=\"https:\/\/nectusbio.com\/en\/\" target=\"_self\">www.nectusbio.com\n<\/a><\/strong> (the \u201c<strong>Website<\/strong>\u201d) by the <strong>ARGANIUM Cooperative<\/strong>, brand <strong>NECTUS<\/strong> (the \u201c<strong>Seller<\/strong>\u201d).\n\nThe Website is intended for <strong>consumers<\/strong>. Any order placed implies the <strong>full and unconditional acceptance<\/strong> of these T&amp;Cs.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Produits<\/h2>\n\n\n\n<p>NECTUS markets in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\"><strong>Cosmetics<\/strong> based on oils (argan, prickly pear seed, etc.);<\/li>\n\n\n\n<li class=\"translation-block\"><strong>Food products<\/strong> (culinary argan oil, amlou, etc.).<\/li>\n<\/ul>\n\n\n\n<p class=\"translation-block\">The <strong>characteristics<\/strong>, <strong>ingredients<\/strong>, and <strong>usage precautions<\/strong> are indicated on each product page. Product <strong>images<\/strong> are non-contractual but representative. Products are offered <strong>subject to availability<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Prices<\/h2>\n\n\n\n<p class=\"translation-block\">Prices are displayed in <strong>Moroccan dirhams (MAD)<\/strong>, <strong>all taxes included (TTC)<\/strong>, and <strong>excluding shipping fees<\/strong>.<br>\nThe applicable price is the one <strong>shown<\/strong> at the time of the order. <strong>Promotions<\/strong> and <strong>discount codes<\/strong> cannot be combined (unless otherwise specified).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Orders<\/h2>\n\n\n\n<p class=\"translation-block\">The Customer selects items, validates the cart, enters contact details, and chooses <strong>delivery<\/strong> and <strong>payment<\/strong> options.<br>\nThe contract is concluded when NECTUS sends the <strong>confirmation email<\/strong>. NECTUS may <strong>cancel<\/strong> an order in case of <strong>obvious error<\/strong>, <strong>non-payment<\/strong>, <strong>fraud<\/strong>, or other <strong>legitimate reason<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Payment<\/h2>\n\n\n\n<p>Accepted methods:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"translation-block\"><strong>Bank card<\/strong> (CIB\/Visa\/Mastercard) via a <strong>secure provider<\/strong>;<\/li>\n\n\n\n<li class=\"translation-block\"><strong>Cash on Delivery (COD)<\/strong> in Morocco.<\/li>\n<\/ul>\n\n\n\n<p class=\"translation-block\">Orders are shipped only after <strong>payment authorization<\/strong> (except COD). If payment is refused by the provider, the order is <strong>cancelled<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Invoice<\/h2>\n\n\n\n<p class=\"translation-block\">The <strong>invoice<\/strong> is sent by email (and\/or available in the customer account) and includes details of the products, taxes, and fees.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Delivery<\/h2>\n\n\n\n<p class=\"translation-block\">7.1. Areas &amp; Methods \u2014 Delivery within <strong>Morocco<\/strong> via partner carriers. <strong>International delivery: available<\/strong>.<br>\n7.2. Indicative Timeframes \u2014 Order preparation within <strong>24\u201348 business hours<\/strong>, followed by delivery within <strong>24\u201372 hours<\/strong> (excluding weekends\/holidays). Timeframes are not guaranteed in cases of <strong>force majeure<\/strong> or <strong>peak activity<\/strong>.<br>\n7.3. Fees &amp; Free Shipping \u2014 Express delivery is <strong>free from 599 MAD<\/strong> (Morocco). Below this threshold, fees are displayed in the cart\/checkout.<br>\n7.4. Receipt &amp; Reservations \u2014 Risks are transferred upon <strong>delivery of the package<\/strong>. The Customer must <strong>check the condition<\/strong> of the goods and submit <strong>specific reservations within 48 hours<\/strong> to both the carrier and NECTUS in case of damage or missing items.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Right of Withdrawal &amp; Returns<\/h2>\n\n\n\n<p class=\"translation-block\">8.1. Period \u2014 NECTUS grants <strong>14 days<\/strong> from the date of <strong>receipt<\/strong> to <strong>withdraw<\/strong> without justification.<br>\n8.2. Exceptions (Hygiene &amp; Food Products) \u2014 For hygiene\/health reasons, <strong>unsealed or used cosmetics<\/strong> cannot be returned. <strong>Food products<\/strong> (oil\/amlou) cannot be returned if the packaging has been <strong>opened\/altered<\/strong>.<br>\n8.3. Procedure (RMA) \u2014 Notify your return request at <strong><a target=\"_self\">contact@nectusbio.com\n<\/a><\/strong>. After <strong>RMA authorization<\/strong>, the <strong>return address<\/strong> will be <strong>provided by email<\/strong>. Products must be returned <strong>new, unopened, complete<\/strong>, and in their <strong>original packaging<\/strong>.<br>\n8.4. Refund \u2014 Refunds are processed <strong>within 14 business days after the return is validated<\/strong>.<br>\n8.5. Initial Shipping Fees \u2014 <strong>Non-refundable<\/strong>, <strong>except<\/strong> if the return is due to a <strong>NECTUS error<\/strong> or a <strong>confirmed defect<\/strong> (same rules as the Return Policy).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. Non-conformity \/ Defective Product<\/h2>\n\n\n\n<p class=\"translation-block\">In the event of a <strong>damaged<\/strong>, <strong>expired<\/strong>, <strong>leaking<\/strong>, or <strong>non-conforming<\/strong> product, please contact <strong><a target=\"_self\">contact@nectusbio.com\n<\/a><\/strong> with photos <strong>within 48 hours<\/strong> of receipt. NECTUS will, at your choice, provide a <strong>replacement<\/strong>, a <strong>store credit<\/strong>, or a <strong>refund<\/strong>. In such cases, <strong>return and reshipping costs are covered by NECTUS<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. Legal Warranties<\/h2>\n\n\n\n<p class=\"translation-block\">Products benefit from the applicable <strong>legal warranties<\/strong> (conformity \/ hidden defects). Any <strong>misuse<\/strong> or <strong>improper storage<\/strong> excludes warranty coverage.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. Liability<\/h2>\n\n\n\n<p class=\"translation-block\">NECTUS is not liable for <strong>indirect damages<\/strong>. The information provided does not replace the <strong>advice of a healthcare professional<\/strong>. NECTUS is not responsible for <strong>carrier delays<\/strong> or <strong>force majeure events<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. Intellectual Property<\/h2>\n\n\n\n<p class=\"translation-block\">The Website and its elements (texts, visuals, trademarks, logos, photos) are <strong>protected<\/strong>. Any unauthorized <strong>reproduction\/use<\/strong> is <strong>prohibited<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13. Personal Data<\/h2>\n\n\n\n<p class=\"translation-block\">Data is processed in accordance with the Website\u2019s <strong>Privacy Policy<\/strong>.<br>\nRights of access, rectification, erasure, and objection may be exercised at: <strong><a target=\"_self\">contact@nectusbio.com\n<\/a><\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">14. Claims \u2013 Amicable Settlement<\/h2>\n\n\n\n<p class=\"translation-block\">Claims may be submitted to: <strong><a target=\"_self\">contact@nectusbio.com\n<\/a><\/strong>.<br>\nIn case of dispute, the Customer should first seek an <strong>amicable solution<\/strong> (mediation\/conciliation) before taking any legal action.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">15. Force majeure<\/h2>\n\n\n\n<p class=\"translation-block\">In the event of circumstances making performance impossible (strike, disaster, network failure, carrier disruption, etc.), NECTUS\u2019s obligations are <strong>suspended<\/strong> for the duration of the event.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">16. Governing Law \u2013 Jurisdiction<\/h2>\n\n\n\n<p class=\"translation-block\">These Terms and Conditions of Sale are governed by <strong>Moroccan law<\/strong>. Any dispute shall fall under the <strong>competent courts<\/strong> of the Seller\u2019s registered office, <strong>after<\/strong> an attempt at amicable settlement.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">17. Amendments to the T&amp;Cs<\/h2>\n\n\n\n<p class=\"translation-block\">NECTUS may <strong>amend<\/strong> these T&amp;Cs at any time.
